Custody
by Latosha Cooper on 11/30/10In Maryland, courts decide issues of child custody using the standard, the "best interest of the child." This means that that the court is making it's decision based on what is best for the child not the parent. In making that determination, judges weigh several factors. Those factors include:
- Willingness to share custody
- Fitness
- Child's relationship with parents
- Child's preference
- Ability to stabilize school and social life
- Proximity between parents' homes
- Employment Considerations
- Age and number of children
- Financial Status
- Benefit to Parent
New Foreclosure Mediation Law
by Latosha Cooper on 07/23/10
On July 1, 2010 Maryland enacted House Bill 472 allowing homeowner's a chance to request mediation. Under the new law lenders must provide information to borrowers about loan modifications, assistance available from government and non profit organizations, and any programs that the lender has developed. If the homeowner requests a modification the lender must consider and document its decision before foreclosing on a home. But before the lender can initiate the foreclosure it must send the owner a request for mediation form. If the homeowner wants to request mediation he or she must file the form with the circuit court and remit a $50 filing fee.
New Maryland Foreclosure Rules
by Latosha Cooper on 06/28/10
On April 4, 2008 the new Maryland foreclosure law went into effect. This new law applies to foreclosure actions filed after that date. Lenders are now required to wait until 90 days after the date you defaulted on your loan, and send you a Notice of Intent to foreclose 45 days prior to instituting an action.
If your lender has filed a foreclosure action you may still be able to save your home by modifying your mortgage, selling your home in a short sale, or fighting any defects in the lender's filing.
Do I qualify for Social Security Disability benefits?
by Latosha Cooper on 06/28/10
You may qualify for Social Security Disability benefits if you meet the definition of disability. Disability is defined as the inability to engage in any substantial
gainful activity (SGA) by reason of any medically determinable physical
or mental impairment(s) which can be expected to result in death or
which has lasted or can be expected to last for a continuous period of
not less than 12 months.
What is SGA?
SGA means the performance of significant physical and/or mental activities
in work for pay or profit, or in work of a type generally performed for
pay or profit, regardless of the legality of the work. For 2010 a person making over $1000 per month is considered engaging in SGA.
